Hinweise zur Nutzung des Mitarbeiter- und des Agentur-Portals
Die CeramTec GmbH stellt auf der CeramTec Digital Asset Management (DAM) Plattform unter https://ceramtec-group.CANTO.de urheberrechtlich geschützte Inhalte wie Bilder und Videos („Assets“) online zur Verfügung. Die Nutzung der CeramTec DAM unterliegt ausschließlich den folgenden Nutzungsbedingungen. Mit Zugriff auf die Plattform gelten die Nutzungsbedingungen als akzeptiert.
Alle Assets der Online-Datenbank sind urheberrechtlich geschützt. Ergänzend ist der Datenschutz, die Persönlichkeitsrechte und das Recht am eigenen Bild zu berücksichtigen. Bei jeder Veröffentlichung ist der Urheber/Fotograf und die Asset-Quelle (in der Regel CeramTec, jedoch falls nicht, ist eine Referenz im Bereich Produkt Details/Produkt ID hinterlegt) anzugeben. Personenbezogene Daten (wie z.B. Fotos von Mitarbeiter) dürfen nur verwendet werden, wenn die jeweilige Einwilligung dokumentiert in CANTO vorliegt. Bitte beachten Sie, dass diese Einwilligung jederzeit widerrufen werden kann und dann eine weitere Nutzung der Daten nicht mehr möglich ist.
Die Assets können für redaktionelle Zwecke in Medien genutzt werden. Hierfür räumt die CeramTec GmbH ein einfaches Nutzungsrecht ein. Für jede andere Art der Nutzung ist eine Zustimmung notwendig. Die Zustimmung ist beim Medical Marketing Management der CeramTec einzuholen über medical_products@ceramtec.de. Die CeramTec GmbH behält sich vor, die Nutzungsgenehmigung im Einzelfall jederzeit zu widerrufen, mit der Folge, dass die Nutzung der heruntergeladenen Assets zu unterlassen ist.
Die Nutzung ist unentgeltlich.
Eine Veröffentlichung und eine Nutzung für kommerzielle Zwecke (z. B. Anzeigen/Werbung) sowie der Verkauf oder die Einräumung von Unterlizenzen der Assets sind untersagt.
Eine Archivierung der Assets auf eigenen Speichermedien ist nicht gestattet.
Jegliche Veränderung, Bearbeitung, Montage oder Manipulation der Assets ist unzulässig und bedarf der vorherigen schriftlichen Zustimmung der CeramTec GmbH.
Die Assets dürfen in keinem sinnentstellten Zusammenhang oder in einer die CeramTec GmbH schädigenden Weise wiedergegeben werden. Die Assets dürfen auch nicht im Zusammenhang mit strafbaren, deliktischen oder sonstigen rechtsverletzenden Handlungen verwendet werden. Die Verlinkung auf das CeramTec DAM ist untersagt. Die CeramTec GmbH behält sich das Recht vor, jedem Verdachtsfall einer missbräuchlichen Nutzung nachzugehen.
Eine Entstellung der Assets ist nicht gestattet. Videos dürfen nur geringfügig und in einer nicht sinnentstellenden Weise gekürzt werden.
Die CeramTec GmbH weist darauf hin, dass die Assets mit größtmöglicher Sorgfalt ausgewählt wurden. Im Einzelfall kann jedoch nicht ausgeschlossen werden, dass die Nutzung der Assets nicht die Rechte Dritter berührt. Der Nutzer der Assets wird selbst sicherstellen, dass eine Verwendung der Assets rechtlich zulässig ist. Mit der Bereitstellung der Assets gewährt die CeramTec GmbH keinerlei Garantie, sie werde „as is“ bereitgestellt.
Die CeramTec GmbH behält sich das Recht vor, die in der DAM enthaltenen Daten jederzeit zu löschen und zu verändern. Die gelöschten Daten dürfen dann nicht mehr verwendet werden. Vor Verwendung eines Assets hat der Nutzer deshalb sicherzustellen, dass das entsprechende Asset noch Bestandteil der CeramTec DAM Plattform ist.
Von jeder Veröffentlichung sind verpflichtend Belegexemplare abzugeben so dass die jeweiligen Urheber- und Persönlichkeitsrechte nachvollzogen werden können und bei einem eventuell erfolgten Widerruf oder Auskunftsersuchen die Verwendung der Daten nachvollzogen werden können.
Insbesondere ist:
- Von jeder Veröffentlichung im Druckformat ist dem Medical Marketing Management der CeramTec GmbH zwei Belegexemplare unaufgefordert und kostenfrei zuzusenden;
- Von jeder Veröffentlichung in digitale Formate (PowerPoint, Word etc.) oder bei einer Online-Veröffentlichung ist ein präziser Link an die unten aufgeführte E-Mail-Adresse zu geben.
Ein Belegexemplar bzw. ein Link zu einer Veröffentlichung wird jeweils erbeten an:

Assets aus dem Mitarbeiter-Portal dürfen nur von CeramTec-Mitarbeitern und nur für CeramTec-Zwecke genutzt werden, insbesondere für Präsentationen, Newsletter, Broschüren, Social Media Posts und andere Marketing-Publikationen.
Dabei ist der Copyright-Vermerk zu übernehmen.
Assets aus dem Mitarbeiter-Portal dürfen nicht ohne vorherige Genehmigung durch den Bereich CeramTec Medical Marketing bzw. Medical Marketing Management an externe Personen weitergegeben werden – weder an Medienvertreter noch an Vertriebspartner.
Personenbezogene Daten (wie z.B. Fotos von Mitarbeiter) dürfen nur verwendet werden, wenn die jeweilige Einwilligung dokumentiert in CANTO vorliegt. Bitte beachten Sie, dass diese Einwilligung jederzeit widerrufen werden kann und dann eine weitere Nutzung der Daten nicht mehr möglich ist.
Weiterhin gelten die bereits für das öffentliche Portal genannten Regelungen.
Nutzungsbedingungen für das Agentur-Portal
Assets aus dem Agentur-Portal dürfen nur von Agentur-Mitarbeitern und Grafikern, die mit CeramTec GmbH zusammenarbeiten, und nur für CeramTec-Zwecke genutzt werden. Die Verwendung darf nur mit schriftlicher Genehmigung durch CeramTec GmbH stattfinden. Dabei ist der Copyright-Vermerk zu übernehmen.
Assets aus dem Agentur-Portal dürfen nicht ohne vorherige Genehmigung durch den das Medical Marketing Management weitergegeben werden.
Weiterhin gelten die bereits für das öffentliche Portal genannten Regelungen.
Es wird ein kostenloses, von CeramTec GmbH jederzeit widerrufbares, einfaches, nicht übertragbares, nicht unterlizenzierbares Nutzungsrecht an den Assets ausgestellt. Es werden drüber hinaus keine Eigentumsrechte an den Assets ausgestellt.
Es bleibt CeramTec GmbH vorbehalten, die Nutzungsbedingungen jederzeit zu ändern. Eine Information dazu wird stets auf der DAM Plattform erscheinen sowie das Einverständnis eingefordert.
Sollten einzelne Bestimmungen dieser Nutzungsbedingungen ganz oder teilweise nichtig sein oder werden, bleibt die Wirksamkeit der übrigen Bestimmungen davon unberührt. Die Agentur-Mitarbeiter und Grafiker verpflichten sich, anstelle der nichtig gewordenen Bestimmung, eine dieser Bestimmung am nächsten kommende, geltende Bestimmung zu vereinbaren.
Im Verhältnis zu Kaufleuten ist ausschließlicher Gerichtsstand das Amtsgericht Stuttgart. CeramTec GmbH ist jedoch berechtigt, vor dem Gericht zu klagen, das am Sitz des Nutzers ist.
Terms of Use for the public media platform
CeramTec GmbH makes copyrighted content such as images and videos ("Assets") available online on the CeramTec Digital Asset Management (DAM) platform at https://ceramtec-group.CANTO.de. The use of the CeramTec DAM is exclusively subject to the following Terms of Use. By accessing the platform, the Terms of Use are deemed accepted.
All assets in the online database are protected by copyright. In addition, data protection, personal rights, and the right to one's own image must be taken into account. For each publication, the author/photographer, and the asset source (usually CeramTec, but if not, a reference is stored in the Product Details/Product ID area) must be stated. Personal data (such as photos of employees) may only be used if the respective consent is documented in CANTO. Please note that this consent can be revoked at any time and further use of the data is then no longer possible.
The assets may be used for editorial purposes, in which case CeramTec GmbH grants a simple right of use. For all other types of usage, an approval is necessary and must be sought from the Medical Marketing Management of CeramTec via medical_products@ceramtec.de. CeramTec GmbH reserves the right to revoke an approval for use in specific cases, with the consequence that use of the downloaded assets must be refrained from.
Use is free of charge.
Publication and use for commercial purposes (e.g., advertising) as well as the sale or sub-licensing of the assets are prohibited.
Archiving of the assets on own storage media is not permitted.
No modification, editing, montage, or manipulation of the assets is permitted without the prior written consent of CeramTec GmbH.
A distortion of assets, e.g., videos may only be trimmed slightly and in a way that does not distort the meaning.
The assets may not be reproduced in any misleading contexts or in any way damaging to the CeramTec GmbH. Also, the assets may not be used in connection with criminal, tortious, or otherwise illegal activities. Linking to the CeramTec DAM system is prohibited. CeramTec GmbH reserves the right to pursue every suspected case of inappropriate use.
CeramTec GmbH points out that the assets were selected with the greatest possible care. In individual cases, however, it cannot be excluded that the use of the assets does not affect the rights of third parties. The user of the assets will ensure that the use of the assets is legally permissible.
CeramTec GmbH reserves the right to delete and modify the data contained in the database at any time. Deleted files may then no longer be used.
Before using an asset, the user must therefore ensure that the corresponding asset is still part of the CeramTec platform.
In particular:
Two specimen copies of each publication in print format must be sent to CeramTec GmbH's Medical Marketing Management without being requested for and free of charge.
Of each publication in digital formats (PowerPoint, Word, etc.) or in the case of an online publication, a precise link is to be provided to the e-mail address listed below.
A specimen copy or a link to a publication is requested in each case to:

Terms of use for the internal platform for employees
Assets from the internal employee portal may only be used by CeramTec GmbH employees and only for CeramTec GmbH purposes, notably for presentations, newsletters, brochures, social media posts and other marketing publications. Please pay attention to the copyright notice; it must be stated where applicable.
Assets from the internal portal for employees are not allowed to be passed on to external parties – neither to media representatives nor to sales partners – without prior permission from the Medical Marketing or Brand Management Medical Marketing Management.
Personal data (e.g., photos of employees) may only be used if the respective consent has been documented in CANTO. Please note that this consent can be revoked at any time and further use of the data is then no longer possible.
Furthermore, the regulations already mentioned for the public portal apply.
Conditions of use for the platform for agencies
Assets from the internal agency portal may only be used by agency employees and graphic designer who work with CeramTec GmbH and only for CeramTec GmbH purposes. The use may only take place with written permission of CeramTec GmbH. Please pay attention to the copyright notice; it must be stated.
Assets from the agency portal are not allowed to be passed on without prior permission from the Communications and Marketing department of the Corporate Center or the divisions of CeramTec GmbH.
Furthermore, the regulations already mentioned for the public portal apply.
A free, non-exclusive, non-transferable, non-sublicensable right to use the Assets, revocable by CeramTec GmbH at any time, are issued.
Beyond this no rights of ownership to the assets are issued.
CeramTec GmbH reserves the right to change the Terms of Use at any time.
Information about this will always appear on the DAM platform and consent will be requested.
Should individually provisions of these Terms of Use be or become void in whole or in part, the validity of the remaining provisions shall not be affected.
The contracting parties are obliged to agree on a valid provision that comes closest to this provision in place of the provision that has become null and void.
In the relationship with merchants, the exclusive place of jurisdiction is the local court of Stuttgart. However, CeramTec GmbH will be entitled to bring an action before the court having jurisdiction over the registered office of the user.
